On February 5, 2025, 104
Indians were deported back by the US military aircraft- a C- 17 Globemaster- by
the administration of Donald Trump. The deportees were "handcuffed and
their legs were tied with chain" even spent forty hours struggling to
use a washroom.
According to the Indian
nationals who were deported from the United States for entering the country
illegally, they were returned on a military plane while wearing hand and leg
cuffs.
Who is deported from the
US?
The illegal immigrants
who had violated the immigration law of the nation were deported back to their
nations.
What ordeal the deportees
went through while reaching the U.S?
Usually, the illegal
immigrants entered the U.S with the help of their travel agents by using the
"Donkey route".
They were mostly taken to
Qatar, Brazil, Peru, Colombia, Panama, Nicaragua, Mexico and then U.S. During
the whole arduous journey, they cross hills, jungles and even sea. While
crossing the hills, the chance of survival remains least and if someone got hurt,
he was left to die.
How the process of
deportation worked?
Immigrants are usually
sent to a detention facility when they are arrested for breaking US immigration
laws. Until their case is heard in court and a judge decides whether they
should be deported or allowed to stay in the United States, they can be detained.
Expedited removal can often take place without a court hearing, especially when
immigrants enter without the required paperwork or break other entrance
criteria.
Although some may combine air and ground transportation, most deportations are
conducted by air after the removal order is issued. The expense of deportation
is paid for by the US government, and the deported people are usually returned
to their own nations.
Deportees
sent back to India
Will the Deportees be
charged in India with any crime for illegal residency?
It is important to
understand that these individuals will not face any legal consequences in India
for their illegal entry into the United States. Indian laws do not apply as the
offense took place on American soil. However, the Punjab police will investigate
how these individuals managed to enter the United States illegally.
The focus of the investigation will be on whether these individuals fled India
after committing a crime or if human trafficking organizations helped them. If
evidence of these offenses is found, legal action will be taken against them. They
have undergone biometric scans, and even with legitimate documentation, they
will not be allowed to enter the United States. Traveling to these countries is
made more difficult by the fact that about 20 countries, including Canada, New
Zealand, Australia, and the UK, follow the US visa regime.
Can U.S do this and how
the nations confer this power?
Yes, U.S has power to
deport illegal immigrants to their mother land under the U.S Immigration and
Nationality Act. Even while the US has deported Indians in the past under
previous administrations, this is the first time the operation has been carried
out by a military aircraft.
Can India also send back
the illegal migrants?
Yes, India has power to
deport illegal Immigrants to their homeland under the Section 3 (2) (c) of
Foreigners Act 1946, and Section 5 of Passport (Entry into India) Act, 1920.
Political Opinions-
Indian External Affairs
Minister S Jaishankar, while addressing the Rajya Sabha, the upper house
of the Indian Parliament said, “It is the obligation of all countries
to take back their nationals if they are found to be living illegally abroad”.
Oppositions had analysts
that it’s a matter of concern and Indian government should not fail to stand up
for Indian citizens. This is another example, according to political
observers, of the government putting its international reputation ahead of the
dignity of its own citizens.
